Stop The Harassment!
When it acts in the capacity of collecting debts for its own account, DirectTV is not a "debt collector" under federal law. However, it still is subject to the prohibitions and standards of the Florida Consumer Collection Practice Act. The FCCPA dictates hat in collecting consumer debts,no person shall . . . assert the existence of some other legal right when such person knows that the right does not exist. § 559.72(9)
In a case filed against DirectTV and Allied Interstate in 2012, Consumer was a 16 year-old whose grandfather had an account with DirectTV. The lawsuit alleged that Consumer assisted her elderly grandfather by writing checks for him in order to pay his DirectTV account. On May 25, 2009, Consumer’s grandfather passed away and she informed DirectTV of this fact and requested that the services be canceled. After being notified of the death of Consumer’s grandfather, DirectTV changed the name on the deceased grandfather’s account to reflect Consumer's name, a minor, as the person who was solely responsible for payment of the charges. According to the lawsuit, Consumer, and her father, repeatedly informed DirectTV that Consumer was only 16 years-old, a minor, and was not responsible for the debt. Despite being informed of these facts, the lawsuit alleged that DirectTV called the Consumer/minor on numerous occasions to collect the balance on her deceased grandfather's account. The lawsuit further alleged that DirectTV turned the debt over to Allied Interstate for collection.
Understandably, this case settled.
